Mediation is a less formal process in which the disputants select one or more neutral persons (“mediators”) to assist them in reaching a mutually satisfactory settlement of their dispute. An essential difference between arbitration and mediation is that the mediator does not render a decision, but facilitates the communication between the parties so they can reach an agreement.
The USAID SEAD Program operates two Pilot Mediation Centers which provide Mediation Services to businesses, as well as accepting cases referred from the Courts. The SEAD Mediation Centers are located in Peja and Gjilan. Additionally, the AmCham ADR Center offers Mediation Services.
